Terms and conditions

This English translation is provided for convenience. In case of any discrepancy, the French version prevails.

Article 1. Purpose and scope

These terms and conditions govern all services sold by GM Black Queen, sole proprietorship (entrepreneur individuel), SIRET 850 051 996 00047, located in Brunoy (91), hereinafter “the Provider”.

Any person ordering a service is hereinafter “the Client”. Services are offered to individuals acting outside of any professional activity, within the meaning of the French Consumer Code.

Any order implies unreserved acceptance of these terms, made available to the Client before her booking is confirmed. They prevail over any other terms, unless otherwise agreed in writing.

Article 2. Services offered

The Provider offers beauty services: bridal makeup, bridal trial, bridal party makeup, evening makeup, engagements and traditional weddings, all-day presence, one-on-one makeup classes, as well as wig install and wig styling.

The Provider's wig expertise is exercised exclusively on wigs. No work is done on the Client's natural hair, for any reason whatsoever.

The wig is provided by the Client, unless otherwise agreed in the quote. The Provider has an obligation of means: she uses her expertise and professional equipment to achieve the agreed result, without guaranteeing a result identical to a reference photograph, since every skin, every face shape and every wig is different.

Article 3. Quote and formation of the contract

Every request leads to a personalized quote, sent by email or messaging app. The quote specifies the services selected, the date, the place, the detailed price and the applicable travel costs.

The quote is valid for 30 days from the date it is sent. The amount shown by the online quote builder is indicative and does not constitute a quote.

The contract is formed on the twofold condition of the Client's express acceptance of the quote and receipt of the deposit provided for in article 5. The date is only secured once the deposit is received.

A slot request made from the online booking page is not an order. It provisionally holds the requested slot, pending the quote and the deposit. If the deposit is not received within the time stated in the quote, the slot is released and the Client is informed.

Article 4. Prices and travel costs

Prices are stated in euros, all taxes included. VAT not applicable, article 293 B of the French General Tax Code. The applicable price list is the one published on the website on the date of the quote. Only the price in the accepted quote is binding for the service ordered.

Two options, at the Client's choice. The Provider travels: travel costs are paid by the Client, charged at actual cost (taxi, from Brunoy (91)), for each appointment, bridal trial included. Or the Client comes to Brunoy (91): no travel cost is charged.

Travel costs are not included in the amounts shown on the website. They are estimated in the quote and settled at actual cost.

Article 5. Booking, deposit and payment

A deposit of 30% of the quote amount is required to secure the date. The balance, plus actual travel costs where applicable, is paid on the day of the service, once it is completed. Makeup classes follow their own payment terms (article 12).

Accepted payment methods: bank transfer, cash, bank card (payment link or mobile terminal), mobile payment (PayPal, Lydia, Wero).

An invoice is given to the Client for every service. In the event of late payment of the balance, the sums due bear interest at the applicable legal rate, after a formal notice that has remained unanswered.

Article 6. Right of withdrawal (14 days)

When the contract is concluded at a distance or off-premises (phone, messaging app, email, website form), the Client has 14 days from the conclusion of the contract to exercise her right of withdrawal, without giving reasons or paying any penalty, in accordance with article L.221-18 of the French Consumer Code.

To exercise this right, simply send an unambiguous statement to contact@gmblackqueen.fr before the period expires. Sums already paid are refunded within fourteen days of receipt of the request, using the same payment method.

If the service is to be performed before the end of this period, the Client expressly requests it. In accordance with article L.221-25 of the French Consumer Code, she remains liable for the amount corresponding to the service already provided, and the right of withdrawal can no longer be exercised once the service has been fully performed.

Model statement: “I hereby give notice that I withdraw from the contract for the following service, ordered on [date] for [date of the service]: [service]. Name, address, date.”

Article 7. Cancellation or rescheduling by the Client

After the withdrawal period, the 30% deposit is kept by the Provider if the Client cancels. It compensates for the booked date, which could not be offered to anyone else.

Rescheduling is possible, subject to the Provider's availability and to a request made at least thirty days before the planned date. The deposit is then transferred to the new date, once only.

This deduction is the only cost of a cancellation. Whatever the date, including the day before the service or in case of a missed appointment, no amount greater than the deposit is due. The balance is never claimed for a service that was not performed.

Article 8. Cancellation by the Provider

If the Provider is unable to attend, for whatever reason, the Client is informed without delay. The Provider makes every effort to suggest a trusted colleague or a new date.

Failing agreement, the deposit and any sum already paid are refunded in full within fourteen days, with no further compensation.

Both parties thus bear the same risk, limited to the amount of the deposit: the Client loses it if she cancels, the Provider returns it if she cannot honor the date. No additional penalty applies to either side.

The following are considered force majeure, within the meaning of article 1218 of the French Civil Code: events beyond the Provider's control that make performance impossible, such as illness or accident preventing attendance, transport strikes, traffic blockades, severe weather, administrative decisions.

Article 9. How the service takes place

The duration stated for each service is an average. It starts at the time agreed in the quote.

The Client makes sure to be on time, with a clean face free of makeup, and, when the Provider travels, to provide a well-lit workspace, an electrical outlet and access to water.

Any delay by the Client is deducted from the planned duration, with no price reduction. Beyond thirty minutes of delay, the Provider may adapt the service, or even cancel it if her schedule no longer allows it: the agreed amount then remains due.

For a wedding, the bridal trial is strongly recommended. It is a separate service, invoiced separately, with a separate trip.

Article 10. Hygiene, health and allergies

The Provider uses professional equipment cleaned and disinfected between each client, as well as single-use applicators when the product requires it.

Before the service begins, the Client informs the Provider of any known allergy, any ongoing dermatological treatment, any lesion, irritation or recent cosmetic procedure. Otherwise, the Provider cannot be held liable for a skin reaction.

The Provider reserves the right to refuse or interrupt a service in the presence of a contagious condition, an open wound or any situation incompatible with hygiene rules. The service is then due in proportion to the work performed.

A makeup service has no therapeutic purpose and in no way constitutes a care or medical procedure.

Article 11. Wig provided by the Client

The wig is entrusted by the Client under her own responsibility. It must be clean and in good condition. Before working on it, the Provider points out any condition likely to compromise the result: damaged fiber, insufficient density, damaged lace, weakening prior coloring.

Prep work (bleaching the knots, softening) and styling involve a degree of uncertainty inherent to the material. The Provider cannot be held liable for wear, discoloration or damage to a wig whose condition was pointed out before the work and for which the Client asked to proceed.

Wig install and wig styling are two separate services, invoiced separately. Styling is never included in the price of the install.

Article 12. Makeup classes

The makeup classes consist of one-on-one, in-person Sessions of 2 hours. Three options are offered: the Single Session, one Session on the topic chosen by the Client; the Module, that is the 4 Sessions of a Level, assessment Session included, with its handbook and remote follow-up until the assessment; the 3-Level Bundle, that is 12 Sessions across the three Modules, the first one free. Extended follow-up can be added as an option. Sessions cover techniques, shade selection and a routine suited to the Client's skin, with no guarantee that she will immediately reproduce the result on her own.

The launch price is reserved for the first 10 Clients enrolled in a Module or the Bundle. It remains valid for subsequent Modules if the Client takes them within 6 months. The price of a Single Session is deducted from a Module purchased within the following 30 days. This deduction does not apply to the Bundle.

Payment, by way of derogation from article 5. Module: a deposit of at most 30% of the Module price when booking, then the balance in equal parts at each Session. Bundle: a deposit of at most 30% of the price of the first Module, then the balance in equal parts over the 11 paid Sessions. Single Session: paid in full on the day of the Session, with no deposit; by way of derogation from article 3, the contract is formed and the date secured as soon as the quote is expressly accepted. The travel costs in article 4 apply to each Session.

Validity and rescheduling, by way of derogation from article 7. A Module must be completed within 6 months, the Bundle within 18 months, from payment of the deposit. A Session can be rescheduled, subject to the Provider's availability, if the request is made at least 48 hours in advance. A Session cancelled less than 48 hours before, a missed appointment, or a Session not taken by the end of the validity period is lost: it is neither rescheduled nor refunded, and its share of the balance is not claimed. The deposit is kept by the Provider, in accordance with article 7.

Professional equipment is provided during Sessions. It remains the property of the Provider. Only the handbook or the Session sheet and, for a first Module, a brush kit are given to the Client, unless otherwise stated in the quote.

Articles 5 to 8 apply to the makeup classes for anything this article does not cover, including the right of withdrawal in article 6.

Article 13. Image rights

The Provider may wish to photograph or film the result of the service for portfolio and communication purposes. This is optional and requires the Client's prior and express consent, obtained before the service.

This consent can be withdrawn at any time, without justification, by simple request to contact@gmblackqueen.fr. Withdrawal leads to the removal of the visuals concerned from the Provider's channels as soon as possible.

The Client who shares visuals of the service is invited to credit their author.

Article 14. Liability

The Provider has an obligation of means. Her liability is limited to the amount of the service actually paid and does not cover indirect damage, in particular costs incurred with third parties.

The Provider accepts no liability for the loss or theft of personal belongings at the place of the service, nor for any alteration of the makeup after her work is done.

Article 15. Personal data

Data collected during a quote request or a booking is processed in accordance with the privacy policy. Information about the website publisher is available in the legal notice.

Article 16. Complaints and mediation

Any complaint can be sent directly to the Provider, by phone at +33756831814 or in writing to contact@gmblackqueen.fr. A reply is given as soon as possible.

Failing an amicable solution, in accordance with article L.612-1 of the French Consumer Code, the Client may use, free of charge, the consumer mediator the Provider reports to: Société de la Médiation Professionnelle (SMP), Alteritae, 5 rue Salvaing, 12000 Rodez, www.mediateur-consommation-smp.fr. Referral to the mediator requires a written complaint to have first been sent to the Provider.

Article 17. Applicable law and amendments

These terms are governed by French law. In the event of a dispute and failing an amicable agreement or successful mediation, the French courts have jurisdiction.

The Provider reserves the right to amend these terms at any time. The applicable terms are those in force on the date the quote is accepted.
